Important — read first: Harmony Pain Alliance is a connecting platform, not a medical provider. We help you find an acupuncture clinic, but the clinic — not HPA — is responsible for your care. Nothing on this website is medical advice. Always talk to a licensed clinician before making health decisions. These Terms limit HPA's liability (Sections 8 and 9) and describe what you agree to when you submit a form (Section 2).

1. Acceptance of Terms

1.1 Agreement. By accessing or using harmonypainalliance.com (the "Service") or any service operated by Harmony TCM International Group LLC ("HPA," "we," "us"), you agree to these Terms of Use. If you do not agree, please do not use the Service. When you submit a form through the Service, you will be asked to confirm that you have read and agree to these Terms and to our Privacy Policy before the form can be sent.

1.2 Who may submit a form. Forms on the Service are to be submitted by adults (18 years or older). A parent, legal guardian, or caregiver with appropriate authority may submit a form on behalf of another person, including a minor, and by doing so confirms that they have that authority. Whether a clinic accepts a particular patient, including a minor, is decided by the clinic.

2. What HPA Is — and What It Isn't

HPA is a referral and connecting platform. We connect patients in North America with licensed acupuncture clinics and practitioners. Each clinic is responsible for holding the licenses its state requires; HPA relies on information the clinic provides about itself and on public licensing records.

When you submit a form through the Service, we use your information to follow up with you. If you have requested a specific clinic, we forward your information to that clinic so it can contact you and arrange your visit. For general match requests, HPA follows up with you first before connecting you with a clinic.

HPA does not diagnose, treat, or supervise clinical services. Any matching or suggestion HPA makes is based on the needs, location, and language preference you tell us and on information the clinic has provided about itself; it is not a clinical evaluation. You decide which clinic to contact, and the clinic decides whether to accept you as a patient and how to treat you. HPA does not confirm appointments, prices, insurance coverage, or treatment results on behalf of any clinic.

HPA does not:

3. Not Medical Advice

The information on this website — including descriptions of health conditions, acupuncture approaches, and areas of care — is for general educational purposes only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for a consultation with a licensed clinician. If you have a medical question or emergency, contact a qualified healthcare professional or call 911 (or your local emergency number). Acupuncture results vary by individual; any case descriptions or descriptions of a clinic's areas of focus are not a promise of similar outcomes for you.

4. Member Clinic Relationships

Each clinic in the HPA network is an independent licensed business. Your treatment relationship is with the clinic, not with HPA. The clinic — not HPA — is solely responsible for:

HPA or its founder may have business or personal relationships with clinics listed on the Service. A clinic's listing on the Service does not mean HPA endorses the clinic or its practitioners. HPA does not audit, accredit, or continuously monitor any clinic.

5. Acceptable Use

When using the Service, you agree not to:

6. Intellectual Property

Content that HPA creates for the Service — including HPA's text, logos, branding, graphics, and code — is the property of Harmony TCM International Group LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from HPA's content without our prior written consent.

Materials provided by clinics or by other third parties — including clinic names, logos, practitioner biographies, photographs, and descriptions of clinical approaches — remain the property of their respective owners and are used on the Service with the clinic's consent. Where the Service refers to a named acupuncture approach, technique, or system, the reference is descriptive only; it does not mean that HPA owns, licenses, or claims any right in that approach, its name, or any associated trademark.

7. Third-Party Links and Services

The Service may contain links to third-party websites or platforms (such as Jane App for booking, Google Maps for directions, or partner clinic websites). We are not responsible for the content, privacy practices, or operation of those third-party services. Your use of them is governed by their own terms and policies.

If, after submitting a form, you choose to open a clinic's own booking page, anything you enter there is provided directly to that website and to the clinic and is handled under their rules. The information you submitted to HPA through our form remains with HPA and is handled under our Privacy Policy.

8. Disclaimer of Warranties

PLEASE READ THIS SECTION AND SECTION 9 CAREFULLY. THEY LIMIT HPA'S RESPONSIBILITY TO YOU.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied — including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any information on it will be accurate, complete, or current. Information about a clinic — such as its hours, services, languages, accepted payment methods, and practitioner credentials — is provided by the clinic, and HPA does not warrant it.

Some jurisdictions do not allow the exclusion of certain warranties. To the extent such a law applies to you, the exclusions above apply only as far as that law permits, and nothing in these Terms limits any right you have under applicable law that cannot be limited by agreement.

9. Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY.

To the maximum extent permitted by applicable law, HPA and its officers, members, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or related to your use of the Service. Clinical care is provided by the clinic, not by HPA, and HPA is not responsible for the acts or omissions of any clinic or practitioner.

To the maximum extent permitted by applicable law, HPA's total aggregate liability for all claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) one hundred U.S. dollars (US$100) or (b) the total amount, if any, you paid HPA for the Service in the twelve months before the claim arose.

Some jurisdictions do not allow the limitation or exclusion of liability for certain kinds of damages. To the extent such a law applies to you, the limitations above apply only as far as that law permits, and nothing in these Terms limits liability that cannot be limited by agreement, including liability for HPA's own fraud or willful misconduct.

10. Indemnification

If a third party brings a claim against HPA because you (a) knowingly submitted false or fraudulent information, (b) submitted another person's information without that person's authorization, or (c) used the Service to harass, threaten, or impersonate someone or for another unlawful purpose, you agree to reimburse HPA for the losses and reasonable expenses (including reasonable attorneys' fees) that HPA incurs as a result of that claim. This obligation does not apply to the extent a loss is caused by HPA's own negligence, breach of these Terms, or violation of law.

11. Modifications

We may update these Terms from time to time. Changes apply from the "Last Updated" date shown at the top of this page and do not apply retroactively. If we make a material change, we will post a conspicuous notice on the Service before or when the change takes effect. A form you submitted is governed by the version of these Terms and of the Privacy Policy that was in effect when you submitted it; a later change will not expand what we may do with information you already gave us unless you agree to it.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, U.S.A., without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought in the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of those courts. If the law of the place where you live gives you the right to bring a claim in your local courts and does not allow that right to be waived, this Section does not take that right away.

13. Severability; Language

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

The Service is available in English, Spanish, and Chinese. These Terms and our Privacy Policy are written in English. Short notices and form prompts that refer to them are provided in all three languages for convenience. If there is any difference between a translation and the English text, the English text governs.
